New Hampshire Surrogacy Laws

New Hampshire permits gestational surrogacy by statute. Gestational carrier agreements are valid and legally enforceable as long as the requirements of the gestational surrogacy statute are met (N.H. Rev. Stat. § 168-B:10.).

A New Hampshire gestational carrier must be at least twenty-one years old, have given birth to at least one child previously, and have completed a proper physical and mental health examination (N.H. Rev. Stat. § 168-B:9.).

New Hampshire permits traditional surrogacy, as well; however, courts will not grant pre-birth orders. As a result, both types of surrogacy are practiced throughout New Hampshire cities like Manchester, Nashua, and Concord.

Laws Concerning Parentage Orders in New Hampshire

New Hampshire allows for its courts to grant pre-birth parentage orders as long as the requirements of the gestational carrier agreement are met. Either the New Hampshire intended parents or New Hampshire gestational carrier may petition the court for a parentage order declaring the intended parents as the sole parents of the child to be conceived as a result of assisted reproduction (N.H. Rev. Stat. § 168-B:12).

Pre-birth orders will not be granted in New Hampshire traditional surrogacy cases.

Egg and Sperm Donor Law in New Hampshire

Under New Hampshire statute, a person is not a parent of a child conceived through assisted reproduction if the person, except when acting in the capacity of a donor, consents to the performance of assisted reproduction or provides gametes or embryos for use in the assisted reproduction (N.H. Rev. Stat. § 168-B:2).

New Hampshire Stepparent and Second-Parent Adoption Law

Statutory law allows for a New Hampshire stepparent to adopt their spouse’s child. A husband and wife, an unmarried adult, or parent of the adoptee are permitted to adopt. However, unmarried adults may not petition jointly to adopt a child (N.H. Rev. Stat. § 170-B:4).
