Utah Surrogacy Laws

Utah statute permits gestational carrier agreements as long as certain requirements are met (U.C.A. § 78B-15-801.). All parties to the agreement must be twenty-one years of age or older, the intended parents must be married, and the gestational carrier cannot use her own eggs in the assisted reproduction procedure (Id. § 78B-15-801.).

There is no Utah case law or any state statute that explicitly prohibits intended parents from practicing traditional surrogacy.

As a result, both gestational surrogacy and traditional surrogacy are practiced throughout Utah cities like Salt Lake City, West Valley City, and Provo.

Laws Concerning Parentage Orders in Utah

Utah allows for its courts to grant pre-birth parentage orders. A Utah pre-birth order will only be granted if the intended parents are married, and the intended parents may enter into an agreement in which the gestational carrier and her husband (if she is married) relinquish all parental rights to the intended parents upon conception of the child (U.C.A. 78B-15-801.).

Utah intended parents must file a notice with the court that a child has been born to the gestational mother in Utah; this notice must be filed within 300 days after assisted reproduction (U.C.A. § 78B-15-807).

Egg and Sperm Donor Law in Utah

Under statute, a Utah sperm donor, egg donor or embryo donor who donates for the purposes of assisted reproduction is not a parent of a child conceived by means of assisted reproduction (U.C.A. § 78B-15-702).

Utah Stepparent and Second-Parent Adoption Law

Utah statute allows for a stepparent to adopt their spouse’s child (U.C.A. § 78B-6-117.). Utah statute requires that a prospective adoptive parent be married, and courts will not permit an adoption to two cohabitating adults who are not married (U.C.A. § 78B-6-117).
