Louisiana Surrogacy Laws

Louisiana permits the practice of gestational surrogacy. A Louisiana gestational carrier contract is enforceable as long as certain requirements are met. A gestational carrier contract in Louisiana is only enforceable if it is in writing and signed by the gestational carrier, her spouse (if she is married), and both of the intended parents (LSA-R.S. 9:2720.).

Additionally, a Louisiana gestational surrogate must be at least twenty-five years of age and have given birth to a child at least once before contracting to become a gestational surrogate (LSA-R.S. 9:2720.1.).

Gestational surrogacy is permitted and practiced throughout Louisiana cities like New Orleans, Baton Rouge, and Shreveport.

Under Louisiana statute, contracts that would compensate a traditional surrogate in Louisiana are not enforceable (La.Rev.Stat.9:2713.).

Laws Concerning Parentage Orders in Louisiana

Louisiana does not allow for its courts to grant pre-birth parentage orders. When a child is born as a result of a gestational carrier contract, the intended parents must file a motion requesting issuance of a Louisiana post-birth order within three-hundred days after the embryo transfer (LSA-R.S. 9:2720.13.).

Egg and Sperm Donor Law in Louisiana

There is no case law or any state statute governing the rights, interests, and obligations of a Louisiana egg donor, embryo donor, or sperm donor.

Louisiana Stepparent and Second-Parent Adoption

Louisiana statute allows for a stepparent in Louisiana to adopt their spouse’s child provided that certain requirements are met. The petitioning stepparent must be married to the custodial parent of the child and have had physical or legal custody of the child for at least six months prior to filing the petition for adoption (LSA-Ch.C Art. 1243.).
