There is no Oregon case law or any state statute that prohibits would-be parents from practicing either gestational surrogacy or traditional surrogacy in Oregon. Interestingly, a definition for assisted reproduction can be found in Oregon statute (O.R.S. § 109.239.).  

With no case law prohibiting traditional or gestational surrogacy, both types of surrogacy are permitted and practiced throughout Oregon cities like Portland, Salem, and Eugene.

Laws Concerning Parentage Orders in Oregon

Oregon allows for its courts to grant pre-birth parentage orders, but results can vary by county. When Oregon intended parents have enlisted the assistance of a gestational carrier, and therefore the child is genetically related to both intended parents, it is likely that an Oregon court will grant a pre-birth order.

For an intended parent who is not genetically related to the child, the Oregon intended parent will have to proceed with a post-birth adoption.

Egg and Sperm Donor Law in Oregon

Under Oregon statute, if the donor of gametes used in assisted reproduction is not the mother’s spouse, the donor shall have no right, obligation, or interest with respect to any child conceived as a result of the assisted reproduction; and any child conceived as a result of the assisted reproduction shall have no right, obligation, or interest with respect to the donor (O.R.S. § 109.239.).  

As the statute is currently written, it only applies to heterosexual couples and female same-sex couples.

Oregon Stepparent and Second-Parent Adoption Law

Oregon statute allows for a stepparent in Oregon to adopt their spouse’s child provided that certain requirements are met. The parent of the child must consent to the adoption, and both parents and the child must have resided in Oregon for six months prior to filing the petition for an Oregon stepparent adoption (O.R.S. § 109.309.).
